The standard of proof is a preponderance of the evidence, meaning it is more likely than not that each element is true. Unlike criminal cases, where the state must prove guilt beyond a reasonable doubt, the burden in a civil injury case is lower, but it still falls entirely on the plaintiff.
- Duty. The defendant owed you a duty of reasonable care. Drivers owe a duty to follow traffic laws. Property owners owe a duty to keep their premises safe.
- Breach. The defendant failed to meet that duty, such as running a red light, ignoring a building code, or selling a product with a known defect.
- Causation. The defendant's breach directly caused your injuries. You must show a clear link between the negligent act and the harm you suffered.
- Damages. You suffered real, measurable losses. Medical bills, lost wages, pain and suffering, and diminished quality of life are all recognized under Texas law.
Under Texas Civil Practice and Remedies Code § 33.001, Texas follows a modified comparative fault rule. You can still recover compensation as long as you were not more than 50 percent responsible. Under Texas Civil Practice and Remedies Code § 16.003, you generally have two years from the date of injury to file a personal injury lawsuit. Miss this deadline and you lose the right to pursue your claim, regardless of how strong it is.
The real damage often starts long before any deadline. Physical evidence is destroyed. Surveillance footage gets overwritten. Trucking companies overwrite electronic logging data.
