Texas Health and Safety Code Section 481.133 says an individual commits a falsification of a drug test offense by knowingly or intentionally:
(a) Uses or possesses with intent to use any substance or device designed to falsify drug test results.
(b) Delivers, possesses with intent to deliver or manufactures with intent to deliver a substance or device designed to falsify drug test results.
(c) ”Drug test” means a lawfully administered test designed to detect the presence of a controlled substance or marijuana.
What is the punishment for falsifying a drug test in Dallas County?
Using or possessing a drug test falsification device or substance, including fake urine or a urinator, is a Class B misdemeanor, punishable by up to six months in jail and a $2,000 fine. Delivering or manufacturing such a device or substance is a Class A misdemeanor, punishable by up to a year in jail and a maximum $4,000 fine.

- In January 2023, a San Juan man on trial for murder was arrested for a false drug test after a probation officer observed him using a plastic bottle with urine during a random test in Hidalgo County.
- In December 2022, a 23-year-old San Angelo man was arrested for possessing a drug test-falsification device.
- In November 2022, a Wichita Falls man was arrested for a parole violation and possession of a drug test-falsification device when officers found a plastic bladder with a tube that ran down his stomach taped to his shirt near his rib cage. The waterproof bladder had a hand warmer duct-taped to it. His parole officer reported he was not planning on testing the man that day.
- In August 2022, two women in Panola County aged 36 and 44 were charged with possession of drugs and a drug test falsification device
- In Sept. 2022, a 46-year-old Harlingen man was arrested for possessing a drug test-falsification device after officers found a bottle of “fake urine,” according to the report.
- In April 2022, a La Joya ISD police officer was arrested by Texas DPS for possession of a controlled substance, unlawfully carrying a weapon, and false drug test falsification device.
- In October 2022, a 53-year-old Liberty man was arrested on suspicion of failing a drug test by falsification of a device.
- In October 2022, a woman was arrested for falsifying a drug test with a falsification device
- In February 2020, a 22-year-old College Station man was arrested after admitting to selling fake urine to help falsify drug test results. Police spotted a clear plastic bottle in the man’s center console during a traffic stop. He told police it was fake urine to pass drug tests and admitted to selling it to other people for $5 a bottle.
- In January 2018, two Mathis convenience store clerks were arrested for selling synthetic urine used to pass drug tests. Both face charges of falsifying a drug test result.
