Houston Personal Injury Lawyers

When someone else's negligence changes your life, we fight to make it right - with the resources, experience, and trial record to prove it.

Houston Personal Injury Attorneys Who Fight for Maximum Recovery

When a serious accident turns your life upside down, the last thing you should face alone is an insurance company determined to minimize what your injuries are worth. Our Houston personal injury lawyers at Varghese Summersett represent accident victims across Harris County and throughout the greater Houston area, recovering compensation for medical bills, lost wages, long-term disability, and pain and suffering caused by someone else's negligence. We take every case on a contingency fee basis - you pay nothing unless we win.

Houston's roads are among the deadliest in the nation. Harris County recorded over 800 traffic fatalities in 2023 alone, according to TxDOT crash data, and workplace injuries in the region's energy, construction, and maritime sectors add thousands more victims each year. Our attorneys have built a reputation for aggressive, trial-ready representation that makes insurance companies pay attention. We combine former insurance defense experience, prosecutorial backgrounds, and deep litigation resources to give every client every advantage in the fight for fair compensation.

Our firm has earned recognition from Best Lawyers in America and has accumulated over 1,100 five-star reviews from clients across Texas. That reputation was built case by case, client by client - by treating every person we represent with the same commitment we'd give a member of our own family. If you were injured in Houston due to someone else's negligence, we are ready to put that commitment to work for you.

Why Varghese Summersett?

01
The Insurance Insider Advantage

Our founder, Benson Varghese, worked as an insurance adjuster before law school and served as counsel for an insurance defense firm during law school. That firsthand experience means we know exactly how adjusters evaluate claims, what defenses they'll raise, and where those defenses are weakest. That perspective is built into every case our team handles from the moment you hire us.

02
Trial-Ready From Day One

Most personal injury firms settle every case quickly. We prepare each matter as if it will go before a jury - because that credibility is what forces insurance companies to make serious settlement offers. When they know we'll go to trial, they pay more.

03
Direct Attorney Access

Unlike large firms where your case gets handed off to a paralegal, you work directly with your attorney throughout the entire process. You'll always have access to the lawyer actually handling your claim - not a case manager or intake coordinator.

04
Catastrophic Injury Specialists

Our team has specific, documented experience handling the most complex cases - oilfield explosions, industrial accidents, trucking collisions causing catastrophic injury, and wrongful death. These cases require more resources, deeper investigation, and harder fights. We are built for them.

05
No Fee Unless We Win

We advance all case costs - expert witnesses, court filing fees, investigation expenses - so you can focus entirely on recovery. You owe us nothing unless we recover compensation for you. Our interests are perfectly aligned with yours from the first conversation.

06
Deep Houston Roots & Resources

Our Houston team has built relationships with the region's top medical specialists, accident reconstruction experts, oilfield industry consultants, and maritime law professionals. We have the network to support the investigation and the resources to fight major defendants - including corporations, trucking companies, refineries, and government entities - through trial if that's what it takes to win your case.

Frequently Asked Questions

Houston Personal Injury Claims - What You Need to Know

How much is my personal injury case worth? +

The value of your case depends on several factors: the severity and permanence of your injuries, the total cost of past and projected future medical treatment, the income you've lost and the earning capacity you may have permanently lost, the impact of your injuries on your daily life and relationships, and the amount of insurance coverage available from all responsible parties. Some cases also carry exposure for exemplary (punitive) damages when the defendant's conduct was grossly negligent or intentional.

Insurance companies prefer to make early, low offers before you fully understand your situation. We evaluate the complete picture - including future medical needs and long-term quality-of-life impacts - before any negotiation begins, so you don't leave money on the table by settling too quickly.

How long do I have to file a personal injury lawsuit in Texas? +

Texas law generally gives injury victims two years from the date of the accident or injury to file a civil lawsuit, under Texas Civil Practice and Remedies Code Section 16.003. This deadline - called the statute of limitations - is firm. Miss it, and you lose your right to sue entirely, regardless of how strong your case might be.

However, certain exceptions change this timeline. Claims against government entities may require written notice within six months of the incident. Cases involving minors may allow extended filing windows. Medical malpractice cases have their own specific rules. The sooner you contact an attorney, the better chance we have to preserve evidence - surveillance footage gets overwritten, witnesses' memories fade, and physical evidence disappears quickly after an accident.

What if I was partially at fault for my accident? +

Texas follows a modified comparative fault rule under Civil Practice and Remedies Code Chapter 33. Under this system, you can recover damages as long as you were less than 51% responsible for the accident that caused your injuries. Your total recovery is reduced by your percentage of fault - so if a jury finds you were 20% at fault for a crash worth $200,000 in damages, you would receive $160,000.

Insurance companies routinely try to inflate your share of fault to reduce what they owe. They may use recorded statements you make immediately after an accident, social media posts, or prior medical history to argue you share responsibility. Having an attorney before you speak to any adjuster protects your rights and prevents avoidable mistakes that shift blame onto you.

Should I accept the insurance company's first settlement offer? +

Almost never. Initial settlement offers from insurance companies are almost always far below the true value of the claim. Adjusters are trained to make early offers - before you've finished medical treatment, before you understand the full extent of your injuries, and before you've spoken with an attorney who can evaluate your case properly. Accepting a settlement closes your claim permanently, even if you later discover your injuries are more serious than they initially appeared.

Our approach is to refuse to negotiate until we understand the complete picture of your damages - past and future medical costs, lost income, long-term disability, and pain and suffering. Once we have that full picture, we negotiate from a position of strength, backed by the credible threat of taking your case to trial if the insurer refuses to make a fair offer.

What should I do immediately after an accident in Houston? +

The actions you take in the hours and days following an accident can significantly affect both your health and your ability to recover compensation. Seek medical attention immediately - even if you feel fine. Some serious injuries, including traumatic brain injuries and soft tissue damage, don't produce obvious symptoms for hours or days. A medical evaluation creates documentation directly connecting your injuries to the accident.

Document everything you can at the scene: photographs of the vehicles, the roadway, any visible injuries, and the surrounding area. Get names and contact information from any witnesses. File a police report and get a copy. Save every medical record, bill, and receipt related to your injury. Critically, do not give a recorded statement to any insurance adjuster - not even your own insurance company - before speaking with an attorney. Anything you say will be used to minimize your claim.

How does the contingency fee arrangement work? +

A contingency fee means you pay no attorney's fees unless and until we recover money for you. Our fee is a percentage of your total recovery, agreed upon in writing before we begin working on your case. We also advance all costs associated with your case - court filing fees, expert witness fees, investigation and accident reconstruction expenses, medical record retrieval, and other litigation costs. None of those costs come out of your pocket during the case.

If we don't win your case, you owe us nothing - not for attorney's fees and not for the costs we advanced. This arrangement aligns our interests completely with yours: we only get paid when you get paid, and we get paid more when you recover more, which means we are motivated to fight for every dollar your case is worth.

What types of compensation can I recover after a Houston accident? +

Texas law allows injury victims to seek economic damages - your actual financial losses - including past and future medical expenses, lost wages, reduced future earning capacity, property damage, and other out-of-pocket costs directly caused by the accident. These are calculated using medical records, expert testimony, and economic analysis.

You may also recover non-economic damages for intangible harms: physical pain and suffering, mental anguish, disfigurement, physical impairment, and loss of consortium (the impact on your relationship with a spouse). In cases involving gross negligence or intentional misconduct - such as a drunk driver or a company that knowingly operated unsafe equipment - Texas law under Chapter 41 of the Civil Practice and Remedies Code may allow exemplary (punitive) damages designed to punish the wrongdoer and deter similar conduct.

Do I need a lawyer for a personal injury claim? +

You have the legal right to handle your own personal injury claim, and for very minor accidents with minimal injuries, that may be appropriate. However, research consistently shows that represented claimants recover significantly higher compensation - even after paying attorney fees - than those who negotiate directly with insurance companies. Insurance companies have experienced claims teams and defense attorneys whose job is to minimize what they pay you. You deserve someone equally experienced and motivated fighting on your side.

For any accident involving serious injuries, disputed liability, significant medical bills, lost income, or long-term disability, having an experienced personal injury attorney is not just helpful - it is almost always financially essential. The complexity of building and proving these cases, understanding what damages to claim, and navigating insurance negotiations and potential litigation requires dedicated legal experience that most people simply don't have.
